Legal strategies most CPAs never mention, and planning tools typically reserved for business owners.
A W-2 is the least flexible income there is. Withholding takes the tax before the money lands, the standard deductions are capped, and every April the return is a report on decisions nobody made. Above $250K the marginal rate, the net investment income tax and the phase-outs stack, and the usual advice is to max the 401(k) and accept the rest.
The planning that actually moves a high W-2 return happens outside the paycheck. Rental real estate held by a spouse who qualifies for Real Estate Professional Status under section 469 can turn suspended passive losses into deductions against wages. Deferred compensation elections, the timing of equity vesting and exercise, charitable structures and a side business with its own retirement plan each open a lever that the payroll department never will.
We start with the last three returns and the compensation plan, model what each lever is worth in your bracket, and write the plan with the documentation each strategy needs to hold up under examination. You take it to your own CPA or have us implement it.
What we typically see: A 401(k) maxed and nothing else. Passive losses suspended year after year. Equity exercised in the worst possible year. A second-earner household paying a rate no one ever modeled.

Each one is modeled against your numbers and written into the blueprint with the documentation it needs.

Nobody had ever asked what my wife did all week. Once her hours were documented, the rental losses finally counted.
Less than a business owner, but more than most CPAs mention. Real estate held by the household, deferral elections, equity timing and charitable structures are the usual levers. The review shows which apply to you and what each is worth.
Possibly, if they spend more than 750 hours a year in real property trades in which they materially participate, and more time there than in any other work. The hours must be documented as they happen, not reconstructed in April.
No. We write the plan and, if you want, implement it alongside your CPA or take over the filing. Most clients keep the preparer they trust and add the strategy layer.
The strategies compound above roughly $250K of household income, where the marginal rate, the net investment income tax and the phase-outs all apply at once.
